By visiting and registering with TBWE, either as a User (Fan or Brand) or an Advertiser, you are accepting the practices described in this Privacy Policy, as well as our website Terms of Use. What Information TBWE Collects

The term “Information” is used in this policy to refer to both types of information described below, as well as any information you provide to TBWE directly by phone, text, mail or through any other written or oral communication with us.

 

On the TBWE website, personally identifiable information is collected by specifically requesting it from you. In order to become a TBWE user, you must first create an account. To create an account, you are required to provide the following information: username, password, first name, last name, email address, country, state, zip/postal code, gender and year birthday. Optional information includes a user’s education level, income level, and ethnicity. You as a user can choose whether or not to disclose personal information to TBWE LLC and participate in our services.

Users recognize TBWE is a marketing research and advertising-based website with prize giveaways. TBWE asks visitors for their first name and last name to maintain the integrity of TBWE as a prize-giveaway site so that a user registers with only one email address and votes through only one account. Any TBWE member who registers for more than one TBWE account shall forfeit rights to all potential TBWE pending prizes earned under all accounts. TBWE will have the sole discretion to determine if an individual has registered for more than one account and/or is maintaining more than one account. All accounts in question may be terminated in such cases. Please review TBWE’s Terms of Use for more details.

TBWE asks users for their email address so we can contact users for any reasons whatsoever including, and especially, when users are prize winners. “Country,” “State,” “Zip Code,” “Gender,” and “Birthday” are required registration fields as TBWE uses this information to tell our advertisers what “types” of people like their products and their competitors’ products. This demographic information (age, gender, geographical location, etc) is valuable information for advertisers who can use it to deliver more relevant ads to users. Other than when users opt into sharing their email address with the brands they vote for regardless of placing the winning vote, a user’s email address and personal contact information will never be given to our advertisers or third-party websites unless it is deemed necessary for their own personal prize redemption through TBWE’s participating prize sponsors and advertisers, when users do in fact qualify to win a prize from voting for said advertiser. When and if users complete a prize redemption offer form that is hosted by one of our prize partners on our behalf, the prize sponsor may submit all or a portion of the information that you submitted on the form to TBWE. This Privacy Policy does not apply to affiliated companies or participating advertisers and their collection, use and sharing of information. TBWE is not responsible for the Terms of Use, Privacy Policy and prize-redemption instructions of our advertisers or affiliates.

By Accepting our Terms of Use you agree that you grant TBWE, LLC ownership of your registration data in lieu of using the free online platform that tbwe.com is and you understand that TBWE, LLC may share your data with Brands registered with TBWE.com for monetary value or otherwise. TBWE collects and provides data to advertisers on an “all-together” and “general data” basis, and does not single out any individual users unless they are winners and the personal information is required for prize redemption. TBWE will provide a winning user’s personal information (first name, last name, mailing address, email address, phone number) to participating advertisers if it is deemed necessary for prize redemption from that participating advertiser.

*Note : TBWE does not include your first name, last name, email address, mailing address or phone number in the demographic research reports supplied to third parties. This personal information is kept within TBWE to safeguard our users from receiving unnecessary and unsolicited SPAM and marketing messages. TBWE takes this point very seriously as we see it as one of our competitive points of difference on the World Wide Web.

Users will always be notified if and when their name and contact information is required from TBWE or a participating advertiser to fulfill their prize redemption. Users will always have the choice of whether or not to disclose their personal information to the participating advertisers they voted for when they become a TBWE winner and thus users can refuse to receive any prize while continuing to vote on TBWE. TBWE may require users to verify their mailing and shipping addresses for prize redemption. TBWE may require proof of identity such as a copy of your driver’s license, passport or other government issued identification depending on the prizes offered.

b.) Non-Personally Identifiable Information
TBWE also logs non-personally-identifiable information including IP address (a unique string of numbers that is assigned to your computer by your internet service provider), time and date of visits, language, referring website addresses, operating system type, browser type, and aggregate user data from users and visitors to the site. This data is used to manage TBWE, track usage and improve the website services. This non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to members. User IP address are recorded for security and monitoring purposes.

How TBWE Uses and Shares the Information Collected

TBWE collects and combines personally identifiable information and non-personally identifiable information through various sources as outlined in our Privacy Policy. We may share the collected information for any legally permissible purpose in our sole discretion, including but not limited to those explained in this Privacy Policy.

Users may provide our advertising partners and sponsors with information that, when combined with personally identifiable information, provides us with a better idea of who you are, such as your birthday, marital status, payment information, information about your background, interests, health, education, income, ethnicity, career goals, shopping preferences, purchase history, age ranges present in your household, whether or not you own or rent a home, the length of time you have lived at your residence, whether you are a mail order buyer or responder, and any other personal information or unique preference information you provide to us or our advertising partners (collectively with the personally identifiable information, “personal information”). As a TBWE user, you agree that TBWE may monitor, edit or disclose your personal information, if required to do so in order to comply with any valid legal process or governmental request (such as a search warrant, subpoena, statute, or court order), or as otherwise provided in TBWE’s Terms of Use. By using TBWE, you are consenting to having your personal data transferred to and processed in the United States.

TBWE collects and uses your personal information and other data to operate and improve our site and services. These uses may include providing you with more effective member support service, making TBWE easier to use, performing research and analysis aimed at improving TBWE, and providing you with content and communication that are relevant to your interests and preferences, such as an alert that a new prize is available from one of your favorite brands.

TBWE also uses your personal information to communicate with you. We may contact you via email with important account information critical to your membership with us, with offerings from our advertising and business partners, or with responses to your member support inquiries. We may use the physical address and proof of address that you provide to ship prizes to you and to prevent fraud.

TBWE vote results are tabulated for display to voters and for forwarding in summary form to interested website visitors. No personally identifiable information is included and cannot be accessed by the public. Except as described in this Privacy Policy Statement, TBWE will not disclose your personal information outside of TBWE.com without your consent. Winning voters have the ability to choose whether or not their name and profile picture show on TBWE.

Member Submissions and How They Are Used

TBWE may monitor and review Member Submissions. However, TBWE will not be held responsible or liable in any manner for Member Submissions, and any opinions, advice, statements or other information submitted by users is the sole responsibility of the submitting user. User generated content is provided for entertainment purposes, as well as to provide advertisers with consumer opinions, and you should in no way rely on the accuracy, completeness or reliability of any Member Submissions. Note any user submissions, comments, messages or posts uploaded to TBWE with regards to advertisers or persons (celebrities, athletes, musicians, etc) may be forwarded to those advertisers or persons.

As a TBWE user, you will be solely responsible for the content of your Member Submissions, and you agree to indemnify and hold harmless TBWE LLC and its affiliates and agents against any claim or damages arising from your Member Submissions. TBWE aims to post and upload to the public positive, non-defamatory, complimentary comments made by users about TBWE’s participating advertisers or persons in every category.

Relevant Ad Serving

TBWE may serve advertisements to you based, in part, on your IP address, the demographic and geographic information you submitted to TBWE during the website registration process, your web activity, and past purchase information about you that TBWE obtains from affiliated entities (prize sponsors/participating advertisers that you vote for on TBWE and in doing so won a prize which required you to provide participating advertiser with some other information). Our advertising partners and TBWE may also use and optimize personal information about your visits in order to provide relevant advertisements to you about goods and services that may be of interest to you. TBWE passes information to ad networks and ad serving companies so they can deliver relevant advertisements to you. Those web pages will contain a link to that company’s own privacy policy.

TBWE may use information in your profile and voting data without identifying you as an individual to third parties. We do this for purposes such as aggregating how many people in the TBWE network like a band or movie and personalizing advertisements and promotions so that we can provide you the TBWE service. We believe this benefits you. For example, if you continually vote for a favorite band or movie in your profile, TBWE may serve you an advertisement highlighting a concert in your area or the screening of a similar movie in your town. But rest assured we won’t tell the band or movie company who you are. Thus, if you continually vote for a particular brand, TBWE may serve you an advertisement for that brand or a similar brand.

TBWE contains links to sites. Voters should note that when you are on the TBWE LLC website, you may be directed to other websites that are beyond our control. For example, if you mouse click on a banner advertisement, the mouse click may take you off The Best Website Ever website. These other websites may independently collect data, solicit personal information, or send their own cookies to you. You should review the Privacy Policy of these other websites to determine what use is made of the information they collect. TBWE is not responsible for the privacy policies and/or practices on other sites. Our privacy policy only governs information collected on the TBWE website.

TBWE will not permit advertisers or third parties to use your information for any purpose such as contacting you by email, phone, text message, U.S. mail or any other means of communication for any purpose without your permission, unless it is for reasons as described in our Terms of Use and this Privacy Policy. The sole reason an advertiser would want to get in touch with you directly is for prize redemption purposes, meaning you are a TBWE winner and have voted for said advertiser. TBWE shares your information with third parties only in limited circumstances where we believe such sharing is 1) reasonably necessary to offer the TBWE service, 2) legally required or, 3) permitted by you.

How cookies are used by TBWE

Cookies are small pieces of data stored on a user’s computer tied to information about the user. TBWE may use cookies to identify you and allow you to log in once to TBWE, vote through categories, and not have to log in again. As is standard within the industry, cookies are used to identify you the next time you access The Best Website Ever website. We use cookies to let you use our services more easily and prevent a voter from casting too many votes. TBWE also may use cookies to collect information about the pages you view, the links you click, the date and time of your visits, the time spent at each page, the websites you visited just before and just after visiting TBWE, and other actions you take on the website.

Third Party Advertising

Ads appearing on TBWE may be delivered to users by one of our advertising partners or by third party advertisers. They automatically receive your IP address when this happens. TBWE uses physical, electronic and administrative safeguards, including advanced firewall and password protection for our databases, designed to protect the security of data. We are committed to protecting the security of your personal information. We restrict access to your personally identifying information to employees that need to know that information in order to operate, develop or improve TBWE’s services. All member accounts are secured by member-created passwords. TBWE takes precautions to insure that member account information is kept private. TBWE uses a variety of security technologies and procedures to protect your personal information from unauthorized access, use or disclosure. For example, we store your personal information on computer systems with limited access, which are stored in a secure environment. All of your information is restricted in our offices too. Only employees who need the information to perform a specific job are granted access to your personal information. Our employees must use password-protected screen-savers when they leave their desks. When they return, they must re-enter their password to regain access.

A password is used to help protect your account and personal information. It is your responsibility to keep your password confidential. Do not share this information with anyone. If you are sharing a computer with someone, you should always logout before leaving TBWE to protect access to your information from subsequent users. If you feel your password has been compromised, you should change it immediately. After you finish using TBWE, you should log out of your TBWE.com account and close your browser so that no unauthorized persons can use TBWE under your name and account information.

Sharing and Disclosure of Information TBWE Collects

Except as otherwise described in this privacy statement, TBWE will not disclose personal information to any third party unless we believe that disclosure is necessary: (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by TBWE, whether or not a response is required by applicable law; (2) to enforce the TBWE Terms of Use Agreement or to protect our rights; or (3) to protect the safety of members of the public and users of the service. TBWE reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of TBWE LLC or substantially all of its assets to that successor in interest. Your personal information may be transferred in connection with a business transition, such as a merger, acquisition, insolvency, or asset sale.

In order for TBWE to provide all its services, we may hire other companies to provide limited services on our behalf, such as to send email, to perform statistical analysis of our services, to provide member support, or to carry out reward fulfillment. These service providers will be permitted to obtain only the personal information they need to perform their functions. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.

Should TBWE choose to sell or transfer business assets, it is possible that the information we possess may be transferred as part of that transaction. TBWE may decide to retain a copy of the information post sale or transfer.

Children under Age 13 are Not Permitted on TBWE (You must be at least 18 to Register)

TBWE does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for TBWE or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on TBWE. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact TBWE immediately.  You must be at least 18 years old to Register on TBWE, while some pages of TBWE contain content for those at least 21 years old (e.g. Beers, Bars, Vodkas, Dispensaries).

E-Mail Notification/Management

TBWE LLC will notify you via email about upcoming votes, the status of votes you cast, prize giveaways and other news we deem of importance. It is our goal here at The Best Website Ever to only notify people who wish to be informed about such events.

Customer Service and Fulfillment

TBWE may use your information to service your account and to fulfill rewards earned through TBWE and participating advertisers’ websites. We may also use your information to verify your identity or claimed account status and, where we consider appropriate, investigate your compliance with the Terms and Conditions of the website promotion of any advertiser offer. We do retain customer service correspondence.

Government Forms

TBWE may be required to create, collect, maintain, and submit certain information required by the government, such as your license, IRS Forms W-9 and 1099. This information, which may include your taxpayer identification number, will not be used, shared, transferred, or sold for marketing purposes.
